MerchMan Terms of Use
MerchMan (“Merchant & Merchandise Manager”) is a multi-tenant point-of-sale and loyalty product operated by ApeXhit LLC at https://merchman.apexhit.org. Contact: apexhit.org. Operating location for notices: Florida, United States. Email references on this site use apexhit.org.
1. Who these terms cover
- Platform founder and enrolled platform agents — ApeXhit staff who provision tenants, run support sessions, and (if gated) clear records.
- Store operators — the business owner and store staff (owner, manager, cashier, and custom roles) who use the store dashboard and register.
- Loyalty members — shoppers who create an account on a store’s public loyalty portal.
The store operator is the merchant of record for goods sold in that store. ApeXhit LLC provides software. We are not the seller of the store’s inventory unless a written addendum says otherwise.
2. The product today
MerchMan currently includes, per activated tenant:
- Owner dashboard, C.O.A.T. menus (Client, Output, Admin, Team), and a cashier register (PWA).
- Catalog, inventory, barcode/QR product codes, spreadsheet import/export.
- Customers, loyalty points (stores may name a custom points currency), receipt claim within 7 days, rewards shop, and referral codes.
- Sales cart, discounts, cash tender rules, voids/unvoids, email and print receipts, receipt QR codes (loyalty portal and optional store link).
- Shift open/close, break timers, cash variance, shift reports.
- Staff roles, custom roles, and per-role feature gates. Founder may feature-gate tenants and enrolled agents.
- Test mode for practice sales and shifts. Test rows can be deleted by owner/manager; founder may clear more broadly when gated.
- Payments settings for cash, cards, mobile wallets, and QR. Philippines defaults to PayMongo / GCash / Maya / QR Ph; United States defaults to card / wallet / generic QR. Card numbers are not stored in MerchMan.
- Support sessions with audit / paper trail. Founder support is not the store owner.
3. Accounts and access
You must keep passwords, PINs, and 2FA codes confidential. Store owners control staff gates. Founder support can read and write only when a support session is open and only within the gated operations for that agent. Do not share founder credentials with store staff.
4. Loyalty, rewards, and referrals
Each store runs its own loyalty program. Points have no cash value unless that store says so in its own posted policy. A receipt can be claimed once and only if it is not voided and is not older than seven (7) days. Points already granted at the register are not granted again on portal signup. Referrals may award a one-time bonus; optional recurring referral rates, if a store enables them, must follow that store’s local advertising and consumer rules. Rewards shop redemptions debit points and are fulfilled by the store, not by ApeXhit LLC.
Creating a loyalty account means you agree to these Terms and the Privacy notice for that store’s portal.
5. Payments
Cash, wallet QR, and “mark as paid” flows are confirmed by store staff. Card and e-wallet acquiring (PayMongo, Stripe, GCash for Business, Maya, QR Ph, or others the store enables) is provided by those processors under their own terms. MerchMan does not claim PCI-DSS, BSP, or card-network certification by publishing these pages. Chargebacks, payouts, and MDR fees are between the store and the processor.
6. Planned SaaS tiers and billing
MerchMan is intended to be sold as subscription software. Planned store plans (names and limits may change before launch):
- Starter — single register, core catalog, basic reports, standard loyalty.
- Pro — extra staff seats, rewards shop, referrals, advanced reports, more payment methods.
- Enterprise — multi-register / higher volume, custom roles, priority support, optional dedicated onboarding.
When billing is turned on, ApeXhit LLC expects to use Lemon Squeezy (or a successor merchant of record) to collect subscription fees. Lemon Squeezy’s buyer terms and prohibited-product rules would apply to paid plans in addition to these Terms. Feature gates already in the product (tenant gates and staff gates) will be mapped to those tiers. Unused trial tenants may be suspended. Price, included modules, and overage rules will be shown at checkout before you pay. These tier names are a product roadmap, not a current invoice.
7. Acceptable use
No unlawful goods, no card testing, no scraping other tenants, no bypassing gates, no using test mode to disguise live tax-liable sales. Founder may suspend a tenant that violates processor or platform rules.
8. Data, backups, and deletion
Operational data is stored in a shared database keyed by merchant id. Founder and owner tools can export or delete selected records. Deletion is irreversible. Old POS Master / Agent apps may still read the same tables during cutover; activating MerchMan does not by itself erase that data.
9. Disclaimer
Software is provided “as is.” ApeXhit LLC is not your accountant, tax preparer, or payment facilitator. Shift clocks, cash variance, and loyalty math are operational aids. Governing law and venue will be confirmed in the attorney-reviewed version; until then this page is a product disclosure, not a forum-selection clause.
